Terms and Conditions
Thanks you for using this website and/or considering to purchase programs from this site, made available to you by KDG Ventures LLC DBA The Art of Applying (“The Art of Applying”), a Texas limited liability company. By using this website or purchasing programs from this site, you (“you” or “User”) expressly agree to be bound, without modification, to this Terms & Conditions Agreement (“Agreement”). If you do not agree to be bound to this Agreement, you cannot use this site or purchase any programs from this site.
The Art of Applying reserves the right to change this Agreement at any time, at its sole discretion. If The Art of Applying makes any changes, it will notify you at the email address provided by you (if you purchase a program), and it will post any such changes here. You are responsible for reviewing any such amendments. Your continued use of this site or The Art of Applying programs after posting of an amended Agreement constitutes your acceptance of any such modified terms. This Agreement was last modified on July 2, 2015.
Purchase Terms
Refunds. Please review the program you are considering and ask any questions before making a purchase. The Art of Applying does not provide refunds except upon its sole discretion.
Forfeiture. Programs have limited capacity and are subject to strict timelines in order to service all customers and clients. If you purchase a program but fail to provide materials or respond to emails within two weeks (14 days) of any communication from The Art of Applying, your program will be deemed forfeited. Payments will not be refunded.
No Guarantees or Warranties. The Art of Applying does not guarantee admission into any university, fellowship program, job, or position.
Information. You agree that The Art of Applying may use an anonymized version of your materials (such as emails and essays) with future clients or customers, or for marketing purposes. Any identifying information will be kept confidential.
Intellectual Property and Confidentiality. The Art of Applying owns the copyrights and other intellectual property rights in any materials provided under this Agreement. You have a license to use such materials only for your own personal, private use, and you will keep all materials private and confidential, including other client’s anonymized materials. You will not disclose any such proprietary or confidential materials to any third parties, except as required by law. You shall take all measures reasonably necessary to protect such materials.
Disclosure. You understand that any program you purchase on this site is not legal advice, financial advice, psychotherapy, or mental health counseling.

General Legal Terms

Damages. To the extent allowed by law, under this Agreement, The Art of Applying will not be liable for indirect, special, incidental, punitive, exemplary or consequential damages, regardless of legal theory, whether or not they have been warned of such damages, and even if all other remedies would fail.
No Waiver. None of the terms of this Agreement can be waived or modified except by an express agreement in writing signed by all of the parties.
Entire Agreement. This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous written or oral agreements between them or any of their affiliates, with respect to the subject matter contained herein.
Assignment. You will not assign this Agreement to any other party without The Art of Applying’s written consent.
Severability. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remainder of this Agreement shall not in any way be affected or impaired.
Governing Law and Jurisdiction. This Agreement shall be governed by, and construed under, the laws of the State of Texas. Jurisdiction and venue for all purposes shall be in the County of Travis, State of Texas. The parties consent to jurisdiction in the County of Travis, State of Texas.
